Terms of commission

These terms govern work commissioned from Toolkitcraftbase, 70 Lincoln Green Lane, Church End, AL3 2XR, United Kingdom. By sending files or paying a deposit you accept them. They are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.

The work

We prepare charts, written packs, and newsroom briefings on media audience engagement and content performance reporting. A written confirmation (email is enough) sets the title, period, fee, and delivery date. We do not supply software, hosting, or a login.

Your files

You warrant that you have the right to share the extracts, BARB, RAJAR, PAMCo, ABC, or survey files you send, and that sharing them with us for this commission does not breach a research contract or employment duty. You remain responsible for how you use the pack inside your organisation and with advertisers.

Intellectual property

On full payment, you may reproduce the pack internally, in conference, and in confidential sales conversations. You may not resell the charts as a syndicated product, publish them as our endorsement of a title, or remove Owen Mallory’s chart credit where it appears. We retain the right to reuse anonymous methods and chart forms on later commissions. We will not name your title in our journal without consent.

Confidentiality

Unpublished figures stay unpublished. We destroy working extracts within twelve months of delivery unless a retainer requires us to keep a comparable baseline, in which case we keep them locked and named to the commission.

Liability

Charts reflect the files you supplied. We are not liable for commercial decisions, editorial staffing, or advertising rates set after a briefing. Our aggregate liability for a commission is limited to the fee paid for that commission, except where the law does not allow a limit (including death or personal injury caused by negligence, or fraud).

Timetable

Dates depend on a complete file set and a named contact who answers fact queries within two working days. Delay on your side moves delivery by the same number of working days.
